On October 2, Pat Driscoll was found guilty of two counts of having sexual intercourse with a child (sec. 944.10 (1), Stats.) and three counts of indecent behavior with a child (sec. 944.11 (2) and (3)). Specifically, count one charged Driscoll with having sexual intercourse on November 18, 1968, with the daughter of his wife by a former marriage, a person under eighteen years of age. Count two charged Driscoll with consenting to the indecent use of his privates by the child on October 19, 1968. Count three involved the indecent use by Driscoll of the privates of the child during July or August of 1968, and count four involved a consent by Driscoll to the indecent use of his privates by the child on the same date. Count five alleged Driscoll also had sexual intercourse with the child on this occasion.
