Harold D. Ricketts (Ricketts) appeals the dismissal of his complaint by the district court. The court found, inter alia, that no case or controversy existed and dismissed for lack of jurisdiction. Ricketts had alleged in his complaint that his constitutional rights were violated by the Kentucky Bar Association (the Bar). The Bar had issued a formal opinion stating that a lawyer may not hire a disbarred lawyer or one presently under suspension.Opinion No. KBA E-228. Ricketts, then under suspension, had been employed in a paralegal capacity by a Kentucky attorney. After his employer learned of the opinion, that attorney wrote to the Bar and was informed that the opinion specifically applied to his employment of Ricketts. He then discharged Ricketts.
