Submitted January 29, 1952. 1. Criminal Law — Mental capacity — Change of plea. In prosecution for murder, evidence was sufficient to raise a grave doubt that defendant had mental capacity to appreciate and understand what he was doing and the consequences thereof, when, without benefit of counsel, he pleaded guilty to the charge of murder and therefore defendant should be permitted to change his plea. 2. Criminal Law — Doubt should be resolved in favor of a trial on the merits. On application by accused to change a plea of guilty to a plea of not guilty, all doubt should be resolved in favor of a trial on the merits.
